May 6, 2010 – National Employee Collective and Class Action Lawsuit filed against CVS drug stores alleging CVS required employees to undergo unpaid or “off the clock” security searches.

Legal Claims:

If you are a CVS employee or former employee who was subjected to a security search after you clocked out at the end of the day or for lunch, you have a claim for unpaid wages. If you are a CVS employee or former employee who clocked out for lunch and then was required to work during your lunch break, you have a claim for unpaid wages.

Legal Fees:

You do not have to pay any legal fees upfront. The lawyers would be paid out of any settlement or verdict if successful. This is called a contingency fee.

A common question we are asked from people who have worked at CVS drug stores and have not been paid for that time is: “How do I get more information concerning my unpaid hours or work time?” There have been times employees are asked to work or perform duties for their employer that are considered “off the clock.”

A few examples are:

Running errands outside of the workplace.

Offsite employee meetings

Offsite employee training

Offsite company parties

Off the clock security checks

and many others.

If you have been asked to perform work functions and not have been paid wages for this time, it is important that you explain these your situation to one of our attorneys. The reason is that your employment rights may have been violated and you are owed back wages.

Call to speak to an attorney about your case by calling 1-800-567-8562, ext:13.

On May 24, 2010 – CVS Employees in New York Filed and Overtime Pay Class Action Lawsuit and Wage & Hour Collective Action Against CVS Over Alleged Off-the-Clock Security Searches & Missed Breaks.

This form of class action enables people all over the United State who have attended mandatory meetings, security checks, and other off the clock work functions to file a claim for unpaid wages.

Our law firm filed this class action on behalf of the employees who have been unfairly unpaid for their time. Here is the Press Release.

This class action lawsuit has been filed against CVS (“Defendant”) in the United States District Court for the Eastern District of New York (Case No. 10 Civ. 2075) on behalf of a class of current and former CVS employees, alleging that employees at CVS stores are subjected to off-the-clock security checks at the end of each shift which can take 30 minutes and that CVS employees are forced to work through meal and rest breaks without compensation, wages or overtime pay, in violation of the Fair Labor Standards Act (“FLSA”) and New York State labor laws, according to a class action press release.

National Employee Collective and Class Action Lawsuit Filed Against CVS

Class Action Alleges Employees Subjected to Off-the-Clock Security Searches & Missed Breaks

(PRWEB) May 24, 2010 — A lawsuit has been filed in the Federal District Court of the United States for the Eastern District of New York, Case No. 10 Civ. 2075, on behalf of a class of current and former CVS employees alleging violations of the Fair Labor Standards Act and New York State labor laws. The lawsuit contends that employees at CVS stores are subjected to off-the-clock security checks at the end of each shift which can take up to 30 minutes. It also accuses the Rhode Island based company of forcing employees to work through meal and rest breaks without compensation and of failing to pay overtime wages.

The suit was filed by Jeanne D’Esposito and Gerald Lawrence of Lowey, Dannenberg, Cohen & Hart and Louis Ginsberg of the Law Offices of Louis Ginsberg, P.C. and alleges that after clocking out, employees are required to wait for a manager to be paged and then submit to a search of their person and personal belongings. The suit also maintains that employees are not paid overtime wages and are routinely required to work during paid meal and/or rest breaks and after they clock out.
