CVS Employee Collective and Class Action Lawsuit Filed Alleging Unpaid Wages

May 6, 2010 – National Employee Collective and Class Action Lawsuit filed against CVS drug stores alleging CVS required employees to undergo unpaid or “off the clock” security searches.

Legal Claims:

If you are a CVS employee or former employee who was subjected to a security search after you clocked out at the end of the day or for lunch, you have a claim for unpaid wages.  If you are a CVS employee or former employee who clocked out for lunch and then was required to work during your lunch break, you have a claim for unpaid wages.

Legal Fees:

National Employee Collective and Class Action Lawsuit Filed Against CVS Alleging Employees Subjected to Off-the-Clock Security Searches & Missed Breaks

ROSLYN, NEW YORK,  May21, 2010 – A lawsuit has been filed in the District Court of the United States for the Eastern District of New York on behalf of a class of current and former CVS employees alleging violations of the Fair Labor Standards Act and New York State labor laws. The lawsuit contends that employees at CVS stores are subjected to off-the-clock security checks at the end of each shift which can take up to 30 minutes. It also accuses the Rhode Island based company of forcing employees to work through meal and rest breaks without compensation and of failing to pay overtime wages.

The suit was filed by Jeanne D’Esposito and Gerald Lawrence of Lowey, Dannenberg, Cohen & Hart and Louis Ginsberg of the Law Offices of Louis Ginsberg, P.C. and alleges that after clocking out, employees are required to wait for a manager to be paged and then submit to a search of their person and personal belongings.  The suit also maintains that employees are not paid overtime wages and are routinely required to work during paid meal and/or rest breaks and after they clock out.
